These Terms and Conditions ("Terms") govern your access to and use of the Aivinn mobile application and related services (the "App" or the "Service"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

Plain-Language Summary

Aivinn is an app designed to help you understand your finances better. We use technology, including AI, to show patterns, insights, and suggestions based on the information you choose to enter. These insights are meant to support your understanding, not to tell you what to do.

Aivinn does not give financial advice, does not recommend specific financial products, and does not make decisions for you. Any financial choices you make are always your own. We don't move your money, access your bank account, or take actions on your behalf. The app only shows information and insights.

You can use Aivinn for free or choose a paid subscription. Paid plans renew automatically unless you cancel before the end of the trial or billing period.

Your data is used to provide the service to you. We don't sell your personal data. Some data may be anonymised and used to improve how the app works.

1. Identity of the Provider

The Service is provided by Aivinn AB, a company incorporated under the laws of Sweden ("Aivinn", "we", "us", or "our").

The Service is offered to consumers within the European Economic Area (EEA).

2. Eligibility

2.1 You must be at least 16 years old to create an account and use the Service.

2.2 By using the App, you confirm that you have the legal capacity to enter into a binding agreement under applicable law.

2.3 The Service is intended for personal, non-commercial use only.

2.4 The Service is not designed or marketed for children under the age of 16.

3. Account Registration and Responsibility

3.1 To access certain features, you must create an account and provide accurate, complete, and up-to-date information.

3.2 You are responsible for:

  • All activity carried out through your account
  • Maintaining the confidentiality of your login credentials
  • Ensuring the accuracy of data you input into the App

3.3 Aivinn is not responsible for any consequences arising from incorrect, incomplete, or misleading information provided by you.

4. Description of the Service

4.1 Aivinn provides an AI-driven financial wellness application that offers:

  • Budgeting and expense tracking
  • Categorisation of user-entered financial information
  • Financial insights, patterns, and summaries
  • Educational and informational content
  • Automated alerts, nudges, and behavioural suggestions
  • A financial wellness score and historical comparisons

4.2 The Service is informational and educational in nature only.

4.3 Aivinn does not:

  • Provide financial, investment, credit, debt, legal, or tax advice
  • Act as a financial adviser, credit intermediary, or lender
  • Execute transactions, move funds, or hold user money

5. No Financial Advice or Regulated Services

5.1 Any information, insights, suggestions, or so-called "recommendations" generated by the App are:

  • General in nature
  • Non-binding
  • Provided for informational and educational purposes only

5.2 The Service does not take into account your full financial situation and must not be relied upon as advice.

5.3 You remain solely responsible for all financial decisions and actions you take.

6. Artificial Intelligence and Automated Processing

6.1 The Service uses automated and AI-based systems to generate insights, classifications, scores, and suggestions.

6.2 AI outputs:

  • Are probabilistic and may be incomplete or inaccurate
  • Depend on user-provided data and behavioural patterns
  • Do not constitute professional advice

6.3 The AI does not make decisions with legal effect or decisions that are automatically executed on your behalf.

6.4 All actions with potential financial consequences are initiated solely by you.

6.5 The use of terms such as "recommendation" or similar wording within the App is purely colloquial and does not indicate advisory intent.

6.6 You may choose to ignore, override, or stop using any AI-generated insight at any time.

7. Financial Wellness Score and Comparisons

7.1 The financial wellness score and comparative insights:

  • Are generated automatically
  • Reflect patterns and trends based on user-provided information
  • Do not represent creditworthiness, eligibility, or risk assessment

7.2 The financial wellness score is a descriptive indicator only and does not assess suitability, affordability, or financial risk, nor is it intended to influence specific financial decisions.

7.3 Scores and comparisons are not guarantees of financial outcomes and must not be interpreted as evaluations by a regulated entity.

8. Subscriptions, Trials, and Payments

8.1 The Service is offered on a free and premium subscription basis.

8.2 Premium subscriptions:

  • Are offered on monthly and yearly billing cycles
  • Are priced depending on the user's country and include applicable VAT

8.3 A free trial period of 14 days applies to new premium subscriptions. This trial may be extended to 30 days through referrals or promotional offers.

8.4 Subscriptions automatically renew at the end of the trial or billing period unless cancelled before renewal.

8.5 You may cancel at any time through the App. Cancellation prevents future charges but does not retroactively refund past payments, except where required by law.

9. Right of Withdrawal

9.1 In accordance with EU consumer law, you have the right to withdraw from a paid subscription within 14 days of purchase.

9.2 If you consent to immediate access to the Service during this period, you acknowledge that the right of withdrawal may be limited once the Service has been fully performed.

10. Acceptable Use

You agree not to:

  • Use the App for unlawful or fraudulent purposes
  • Manipulate, reverse engineer, or interfere with the Service
  • Use the Service in a way that harms others or exploits vulnerabilities

Aivinn reserves the right to suspend or terminate accounts for violations.

11. Intellectual Property

11.1 All intellectual property rights in the App and its content belong to Aivinn or its licensors.

11.2 You are granted a limited, non-exclusive, non-transferable right to use the App for personal purposes.

12. Data Protection and Privacy

12.1 Personal data is processed in accordance with applicable data protection laws.

12.2 User data is:

  • Used to provide the Service to you
  • Used in anonymised and aggregated form to improve AI systems

12.3 Data is not shared with third parties for their own purposes, but may be processed by carefully selected service providers acting solely on Aivinn's instructions.

13. Limitation of Liability

13.1 To the maximum extent permitted by law, Aivinn shall not be liable for:

  • Financial losses arising from user decisions
  • Reliance on AI-generated insights or scores
  • Incorrect or incomplete user-provided data
  • Indirect or consequential damages

13.2 Aivinn does not guarantee:

  • Financial improvement
  • Savings outcomes
  • Accuracy or completeness of AI outputs

13.3 Any liability shall be limited to the total amount paid by you for the Service in the 12 months preceding the claim, unless mandatory law provides otherwise.

14. Changes to the Service and Terms

14.1 Aivinn may modify, suspend, or discontinue any part of the Service at any time, including as a result of legal, regulatory, or supervisory requirements.

14.2 Where changes materially affect paid features, users will be informed in advance where reasonably possible.

14.3 These Terms may be updated. Continued use of the App after changes constitutes acceptance.

15. Termination

15.1 You may terminate your account at any time.

15.2 Aivinn may terminate or suspend access if you breach these Terms or if required for legal or regulatory reasons.

16. Governing Law and Jurisdiction

16.1 These Terms are governed by the laws of Sweden.

16.2 Any disputes shall be subject to the exclusive jurisdiction of the Swedish courts, without prejudice to mandatory consumer protections under the laws of your country of residence.
